Mental Health Screening
Has your child been subject to a mental health, depression, suicide or other screening?
Did you give your consent?
If your child was screened without your express written consent, this may be a violation of Tennessee law. There are some very specific situations where a screening may be legal without your consent, but in general the law states that mental health screening is only permitted when:
A parent, guardian, legal custodian or caregiver… of a child under sixteen (16) years of age has provided written, active, informed and voluntarily signed consent that may be withdrawn at any time by the parent, guardian, legal custodian or caregiver… .

“Caregiver” has a specific meaning in this law, it is not just any person giving care.
